DOCUMENTARY OF THE 100 YEARS ANTIQUATED LAND ADMINISTRATION SYSTEM IN THE PHILIPPINES

The country's 100 years antiquated land administration system has become next to impossible for common Filipinos to own their "dream lands," because current land ownership systems and processes, often times clash at each other, thus, giving rise to controversies, contentious claims, and even the proliferation of fake titles.

The structural defects of land administration system covers the following; conflict between laws regulating the system and its administration, dual processes for titling land, multiple forms of ownership rights in land, multiple land valuation methods, multiple property taxes and related disincentives to formalization of land transaction, multiple steps for land transfers and titling processes, and multiple land administration agencies. All these problem causes duplication and overlap in land administration activities, massive delays in the disposition and titling of alienable and disposable lands, incomplete and inappropriate classification of land, ineffective land information systems, delays and costly transactions, lengthy handling of land administration- related conflicts, and expensive court litigation that clog up the courts.

The major symptoms of these problems are; embedded corruption in the bureaucracy; land grabbers in collusion with unscrupulous government personnel have established syndicate-like operations preying on hapless clients; inconsistent records system that favors dubious land claimants and their accomplices in the agencies; land speculators amassing huge landholdings that only remain idle and unutilized; and existence of perpetrators of land scams, fake titles, and other irregularities. These are all reflections that the country's Torrens Tiling system is losing its credibility. "
